Terms and Conditions

Contract terms governing your use of Streamnode Services, plans, billing, and account responsibilities.

These Terms and Conditions (“Terms”) govern your access to and use of Streamnode’s websites, applications, APIs, and related services (collectively, the “Services”). By creating an account, accessing, or using the Services, you agree to these Terms.

If you accept these Terms on behalf of a company or other legal entity, you confirm that you are authorised to bind that entity. In that case, “you” means that entity.

If you do not agree to these Terms, do not use the Services.

1. Age, Eligibility, and Accounts

You must be at least 16 years old to use the Services.

You must:

  • provide complete and accurate registration information;
  • keep your account details up to date;
  • keep credentials confidential;
  • ensure each user has unique login credentials;
  • promptly notify us at [email protected] of suspected unauthorised access.

You are responsible for all activity under your account.

2. Service Plans

Streamnode may offer a free Hobby plan, paid self-service plans (such as Pro), and enterprise plans under separate written order forms.

Features, limits, and pricing for each plan are set out on our pricing pages, checkout flow, or order forms and may change over time.

If there is a conflict between these Terms and a signed enterprise order form, the order form controls for that subject matter.

3. Hobby Plan (Free Tier)

The Hobby plan is offered at Streamnode’s discretion and is intended for personal, educational, testing, and other non-commercial use.

For the Hobby plan:

  • commercial production use is not permitted;
  • capacity, retention, and performance limits are stricter than paid plans;
  • no uptime commitment or SLA applies;
  • we may apply rate limits, throttling, queueing, or temporary pauses;
  • we may disable projects, endpoints, workloads, or accounts that create reliability, security, or abuse risk.

We may modify, restrict, or discontinue the Hobby plan at any time.

4. Acceptable Use Policy

Your use of the Services is subject to our Acceptable Use Policy, which is incorporated into these Terms.

A breach of the Acceptable Use Policy is a breach of these Terms and may lead to enforcement action, including suspension or termination.

Use of our APIs is also subject to our API Terms, which are incorporated into these Terms.

5. Fair Use and Plan Limits

All plans are subject to technical, operational, and fair-use limits, including request, compute, storage, transfer, and retention limits.

If usage materially affects platform stability, security, or other customers, we may require remediation, apply temporary controls, require a plan change, suspend workloads, or terminate affected Services.

Circumventing limits or usage controls is a material breach of these Terms.

6. Your Content

You retain ownership of code, data, files, and other content you submit to the Services (“Your Content”).

You grant Streamnode a worldwide, non-exclusive, royalty-free licence to host, process, transmit, store, display, and otherwise use Your Content only as needed to:

  • provide, secure, and maintain the Services;
  • prevent fraud, abuse, and security threats;
  • comply with legal obligations and enforce these Terms.

You are solely responsible for Your Content, including legality, accuracy, and rights clearance.

7. Security and Compliance

You are responsible for securely configuring your workloads and integrations, including access controls, encryption choices, and secrets handling.

You must maintain your own backups where business continuity requires them.

You must promptly report actual or suspected vulnerabilities or security incidents relating to Streamnode Services to [email protected].

8. Data Protection and Privacy

Each party will comply with applicable data protection law, including UK GDPR and the Data Protection Act 2018 where applicable.

Our processing of personal data is described in our Privacy Policy.

Our use of cookies and similar technologies is described in our Cookie Policy.

For business customers, additional data-processing terms may apply through a separate Data Processing Addendum.

9. Restrictions on the Service Itself

Except where mandatory law prevents restriction, you must not:

  • reverse engineer, decompile, or disassemble the Services;
  • copy, modify, or create derivative works of the Services except as expressly permitted;
  • remove or alter proprietary notices;
  • use the Services on a timesharing or service bureau basis;
  • export or use the Services in breach of applicable sanctions or export controls.

10. Support and Electronic Communications

Support levels may vary by plan.

You agree to receive operational, billing, legal, and security notices electronically, including by email to your account contact address. You must keep that email address current.

11. Fees, Billing, and Taxes

Paid Services are billed according to your selected plan and applicable order terms.

Unless otherwise stated:

  • recurring subscriptions renew automatically for successive terms;
  • fixed subscription fees are charged in advance;
  • usage-based charges may be billed in arrears;
  • you authorise Streamnode and its payment processors to charge your payment method;
  • fees are non-refundable except where required by law or expressly stated;
  • you are responsible for applicable taxes, including VAT, duties, and similar charges.

If payment fails or is overdue, we may suspend or terminate access to paid Services.

We may change pricing with reasonable notice. Price changes apply from the next renewal or billing cycle unless otherwise stated.

12. Term, Suspension, and Termination

These Terms start when you first accept them or use the Services and continue until terminated.

You may cancel at any time. Unless stated otherwise, cancellation takes effect at the end of the current billing period.

We may suspend or terminate all or part of the Services immediately where reasonably necessary, including for:

  • material breach of these Terms;
  • security, abuse, fraud, or legal risk;
  • non-payment;
  • repeated or serious fair-use violations;
  • prolonged account inactivity.

13. Effect of Termination

On termination:

  • your right to use the Services ends immediately;
  • outstanding fees become due;
  • we may delete Your Content in line with our retention practices, except where law requires retention;
  • sections that by nature survive termination continue to apply.

14. Representations and Warranties

You represent and warrant that:

  • you have all rights and permissions needed for Your Content and use of the Services;
  • Your Content and use of the Services do not infringe third-party rights or violate law;
  • you will use the Services in accordance with these Terms and applicable law.

Each party warrants it has authority to enter into these Terms.

15. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Streamnode disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted, secure, or error-free.

Nothing in these Terms limits any non-excludable statutory rights.

16. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • any liability that cannot be excluded or limited under applicable law.

Subject to the paragraph above, to the fullest extent permitted by law:

  • Streamnode is not liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or loss of profits, revenue, goodwill, or data;
  • Streamnode’s total aggregate liability for all claims arising out of or connected to the Services and these Terms is limited to the greater of (a) GBP 100 and (b) the fees paid by you for the affected Services in the 12 months before the event giving rise to the claim.

17. Indemnity

If you use the Services for business purposes, you will indemnify and hold harmless Streamnode and its officers, directors, employees, and affiliates against third-party claims, losses, liabilities, and reasonable legal fees arising from:

  • your breach of these Terms;
  • Your Content;
  • your unlawful or improper use of the Services.

18. Confidentiality and Intellectual Property

Each party may receive non-public information from the other party. The receiving party must protect that information using reasonable care and use it only for purposes related to these Terms.

This obligation does not apply to information that is public through no fault of the receiving party, lawfully known before disclosure, independently developed, or lawfully received from a third party.

Streamnode and its licensors retain all right, title, and interest in the Services and related intellectual property.

If you submit feedback, you grant Streamnode a worldwide, perpetual, irrevocable, royalty-free licence to use that feedback without restriction.

19. Changes to Services and Terms

We may modify or discontinue parts of the Services from time to time.

We may update these Terms by posting an updated version and, for material changes, by giving reasonable notice (for example by email or in-product notice). Updated Terms take effect on the stated effective date.

Your continued use of the Services after the effective date means you accept the updated Terms.

20. Governing Law and Disputes

These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of England and Wales.

The courts of England and Wales have exclusive jurisdiction over disputes arising out of or in connection with these Terms, except where mandatory consumer protection law gives you the right to bring proceedings in another jurisdiction.

21. General Terms

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganisation, or sale of assets.

These Terms, together with any applicable order forms and incorporated policies, are the entire agreement between you and Streamnode regarding the Services.

Any failure by Streamnode to enforce a provision is not a waiver of that provision.
